How The Process Works

After the Social Security Administration awards SSDI or SSI benefits to a person with a disability, it can review the case at any time to determine if the claimant is medically improved and able to return to work. Before the Social Security Administration (SSA) determines that a claimant is no longer entitled to receive benefits, it notifies the claimant that his or her case is under review.

The SSA obtains updated release forms from the claimant to get information from doctors about the claimant’s medical condition. The SSA may send the claimant for a consultative evaluation with a doctor who is on its panel.

If the Social Security Administration (SSA) determines that a claimant is no longer eligible for benefits, it will notify the claimant of his or her right to request a reconsideration. There are rules that may allow the continuation of benefits through the appeal if the appeal is filed within 10 days of the denial notice. However, if the claim is ultimately denied, the claimant will be responsible for paying back the benefits received during the appeal. If the claimant does not receive a favorable result at the reconsideration stage, the claimant may file for an informal conference.

At this point in the claims process, we file for an informal hearing to seek the reinstatement of benefits for our clients. In most cases, we will represent you at the informal hearing.
